Bob-Dogi (Judgment) [2016] EUECJ C-241/15 (01 June 2016)

Article 8(1)(c) of Framework Decision 2002/584/JHA requires that a European arrest warrant be based on a national arrest warrant that is distinct from the European arrest warrant. If the European arrest warrant does not refer to a separate national arrest warrant and is not based on one, the executing judicial authority must refuse to give effect to it, as it does not satisfy the requirements of lawfulness under Article 8(1).

If the European arrest warrant does not refer to a separate national arrest warrant and is not based on one, the executing judicial authority must refuse to give effect to it, as it does not satisfy the requirements of lawfulness under Article 8(1).
