Article 23 of Framework Decision 2002/584/JHA is not applicable if surrender is not possible due to an asylum procedure; if applicable, extension of the surrender time limit and continued detention is permissible only if a judicial authority finds that force majeure prevented surrender and agrees a new surrender date. Legal obstacles such as asylum applications interrupt the time limits but do not automatically constitute force majeure.
