Procedural Posture

Preliminary Ruling (reference for Preliminary Ruling) / Judgment of the Court of Justice of the European Communities

  1. 1 Whether restrictions on exportation of bank notes were abolished after the transitional period under Article 67(1) EEC Treaty
  2. 2 Whether failure to use Article 73 safeguard procedure infringes the Treaty
  3. 3 Whether non-residents have a right under Community law to re-export previously imported currency

Ratio Decidendi

Restrictions on the exportation of bank notes were not abolished after the transitional period, as the Council had not liberalized such movements under Article 69. Member States retain the power to impose control measures and criminal penalties for such transactions, as they are not obliged to liberalize them under the EEC Treaty or implementing directives.
