Ratio Decidendi

The Court held that the Commission failed to establish concertation on transaction prices because the statement of objections did not clearly set out this allegation, infringing the applicants' rights of defence. The Court further held that the Commission did not provide a firm, precise and consistent body of evidence that concertation on announced prices occurred, as the parallelism and simultaneity of price announcements could be explained by the market's oligopolistic structure and transparency. However, the Court found that within KEA, members did concert on announced prices and exchanged information, constituting a restriction of competition.
