Ratio Decidendi

The requirements of judicial independence under Article 47 of the Charter are not satisfied by a chamber such as the Disciplinary Chamber of the Supreme Court of Poland, established under the circumstances of these cases, due to the manner of appointment of its judges by a body (NCJ) whose independence is not guaranteed from the legislative and executive authorities. Where a national court or tribunal does not meet the requirements of independence under EU law, national provisions conferring jurisdiction on such a body must be disapplied to ensure effective judicial protection.
