Ratio Decidendi

Natural periodic flooding or submersion of meadows and pastures in a special protection area does not constitute 'crop rotation' within the meaning of Article 2(c) of Regulation No 1120/2009. Such phenomena are not agricultural practices, do not result in the succession of different crops, and do not alter the use of the land as permanent pasture. Excluding such land from the definition of permanent pasture would undermine the objectives of environmental protection and maintenance of permanent pasture under EU law.
