Article 3(1a), fourth subparagraph, point (iii) of Directive 2004/109/EC precludes a Member State from imposing stricter notification requirements for major holdings unless the supervision of such requirements is entrusted to an authority designated under Article 4 of Directive 2004/25/EC. The Austrian regime failed this requirement, as supervision was by an authority not so designated.
