The Board of Appeal correctly found that the evidence established genuine use of the earlier mark for relevant goods and services, and that the marks at issue are visually and conceptually similar to an average degree and phonetically similar to an above-average degree. Given the enhanced distinctiveness of the earlier mark and the similarity of the goods and services, there is a likelihood of confusion under Article 8(1)(b) of Regulation No 207/2009. The applicant's pleas are rejected.
