Ratio Decidendi

The Court held that the Commission's decision was valid and sufficiently reasoned, and that the procedure respected the right to be heard. National authorities must conduct an autonomous administrative procedure, allowing the beneficiary to present observations, before applying a financial correction following a Commission decision. National courts are bound by the Commission's definitive findings unless they refer questions of validity to the Court of Justice. Article 47 of the Charter does not preclude national courts from being bound by such decisions, provided the possibility of a preliminary reference exists.
