Ratio Decidendi

The coexistence agreement did not constitute express consent to the registration of the contested EU trademark, as required by Article 53(3) of Regulation No 207/2009. The agreement was limited to Italian marks existing at the time of signature and did not mention the contested mark or EU registrations. The applicant failed to prove coexistence of the marks without confusion. Therefore, the nullity action based on risk of confusion was admissible and the appeal was dismissed.
