A product composed of lysine sulphate and impurities deliberately left to render it suitable for animal feed must be classified under heading 2309 of the CN, not 2922 or 3824, as the impurities determine its specific use. Production refunds paid on the basis of an incorrect classification are contrary to EU law, and the principle of legitimate expectations does not preclude recovery of such sums or refusal to honour refund certificates, even if the producer acted in good faith.
