Procedural Posture

Preliminary Ruling (cjeu) / Judgment on Reference From National Court

  1. 1 Whether bilateral agreements between insurance companies and car repairers/dealers, linking hourly repair charges to the number/percentage of insurance policies sold by the dealer as intermediary, constitute a restriction of competition by object under Article 101(1) TFEU.

Ratio Decidendi

Article 101(1) TFEU must be interpreted as meaning that agreements whereby car insurance companies enter into bilateral arrangements with car dealers/repair shops or their association, linking the hourly repair charge to the number and percentage of insurance contracts sold by the dealer as intermediary, can be considered a restriction of competition by object if, after concrete and individual examination of the agreements' wording, aim, and context, they are by their nature injurious to normal competition on one of the relevant markets.

Court Disposition

Preliminary ruling issued; interpretation of Article 101(1) TFEU provided.

Orders

  • Article 101(1) TFEU can cover such agreements as restrictions by object if, after examination, they are by their nature injurious to competition on one of the relevant markets.
  • Costs are for the national court to determine.
