The Court held that the Commission infringed Article 8(2)(a)(i) of Regulation No 1925/2006 by prohibiting all preparations from the leaf of Aloe species containing HADs, irrespective of the amount present, without establishing that ingestion would greatly exceed normal dietary intake or otherwise represent a potential risk.
