Ratio Decidendi

Article 5(2)(b) of Directive 2001/29/EC does not preclude national legislation that applies a private copying levy indiscriminately on recording media, provided there is an effective right to reimbursement and practical difficulties justify the system. A rebuttable presumption of private use for natural persons is permissible if justified by practical difficulties and does not result in unjustified levies. Allocation of part of the compensation to social and cultural institutions is allowed if it benefits rightholders and is non-discriminatory. Payment of a comparable levy in another Member State does not exempt from payment in the Member State where private copying occurs.
