Ratio Decidendi

The applicant's conduct—leaving his post, returning to the UK, and taking up new employment—constituted a clear and unconditional termination of the contract by the applicant himself, rendering the subsequent termination letter from the Commission ineffective and not an act adversely affecting him. As the applicant terminated the contract without notice, he forfeited any entitlement to compensation under Article 47 of the Conditions of Employment. The only admissible financial claim was for compensation under Article 47, but this was dismissed as unfounded in law.
