Ratio Decidendi

Article 6 of Regional Law No 68/95 constituted a new aid scheme for a different period than the previously approved scheme under Article 48 of Regional Law No 32/91. The Commission was entitled to assess it as new aid, and did not infringe Article 88(1) EC, the principles of legitimate expectations or legal certainty, nor essential procedural requirements. The Commission applied the correct temporal rules and did not retroactively apply the Communication on operating loans. The action was admissible but unfounded.
