Ratio Decidendi

The Court held that the aid granted by the Friuli-Venezia Giulia Region to road haulage contractors from 1 July 1990 onwards constitutes State aid within the meaning of Article 92(1) EC, as it is capable of affecting trade between Member States and distorting competition, regardless of the amount or size of the recipients. The aid is not covered by any derogation under Article 92(2) or (3) EC or Regulation No 1107/70. The Commission was entitled to order recovery of the incompatible aid, and the applicants' arguments on proportionality, legitimate expectations, and compensatory justification were rejected.
