Article 3(1) of Directive 2009/73/EC must be interpreted as meaning that requiring suppliers to offer natural gas at regulated tariffs constitutes by its nature an obstacle to a competitive market, even if alternative offers are allowed. However, Article 3(2), read with Articles 14 and 106 TFEU and Protocol No 26, allows Member States to impose public service obligations on undertakings in the gas sector for objectives such as security of supply and territorial cohesion, provided the obligations are non-discriminatory and proportionate. Methods of price determination based on costs are not precluded if they do not exceed what is necessary for the objectives pursued.
