Article 102 TFEU applies to copyright management organisations with a monopoly that set rates affecting cross-border trade. Unfair/excessive pricing can be established by comparing rates with those in other Member States, using objective and consistent criteria, including PPP index and relevant user segments. A significant and persistent difference in rates is indicative of abuse unless justified by objective factors. For fine calculation, remuneration for rightholders must be included in turnover if it forms part of the value of services provided and is necessary for an effective, proportionate, and dissuasive penalty.
