Ratio Decidendi

The exclusion of citizens who do not declare affiliation with a 'constituent people' from standing for election to the House of Peoples and the Presidency constitutes discrimination without objective and reasonable justification, violating Article 14 in conjunction with Article 3 of Protocol No. 1 and Article 1 of Protocol No. 12. The applicant's continued ineligibility is identical to the situation in Sejdić and Finci, and the lack of objective criteria for ethnic affiliation renders the exclusion arbitrary and unjustified.
