The restrictive measures against Bank Mellat were annulled because the Council failed to provide adequate reasons, did not respect the applicant's rights of defence and right to effective judicial protection, and made a manifest error of assessment. The Council did not sufficiently substantiate the allegations against Bank Mellat, and the evidence relied upon was either not disclosed in good time or was insufficient to justify the measures. The applicant was entitled to rely on fundamental rights protection before the EU courts.
