Ratio Decidendi

Article 78(1) GDPR, read with Article 47 of the Charter, must be interpreted as meaning that where a data subject exercises the remedies provided for in Articles 77(1) and 79(1) GDPR, the court required to adjudicate on an action against the decision of a supervisory authority is not bound by the decision adopted by the court seised under Article 79(1) as to whether there has been an infringement of the rights which that data subject derives from the regulation. The remedies may be exercised in parallel, neither having priority, and Member States must establish mechanisms to avoid contradictory decisions within the same Member State.
