Ratio Decidendi

Articles 3 to 5 of Directive 98/70/EC do not preclude national legislation requiring petroleum companies to place on the market, in the same calendar year, a quantity of biofuels blended with petrol and diesel, provided the percentages comply with the Directive's maximum limits and apply to annual totals, not each litre. Article 8 of Directive 98/34/EC does not require notification of such legislation where, after initial notification and Commission observations, the draft is amended accordingly and communicated to the Commission.
