Article 16(3) and (4) of Directive 2003/87/EC must be interpreted as requiring the imposition of a penalty on operators who fail to surrender, by 30 April, the carbon dioxide equivalent allowances equal to their emissions for the preceding year, regardless of whether they hold sufficient allowances on that date or the reason for the failure. The penalty amount set by the Directive may not be varied by national courts on grounds of proportionality.
