Ratio Decidendi

The Board of Appeal erred in defining the relevant public too narrowly and failed to establish that a significant part of the relevant public in Germany knew 'Compton' as a geographical indication for the goods at the relevant date. Therefore, the conditions for finding the mark descriptive or non-distinctive were not met, and the annulment of the registration was not justified.

Court Disposition

Appeal allowed; Board of Appeal decision annulled.

Orders

  • The decision of the EUIPO Board of Appeal of 16 September 2022 (R 1913/2021-2) is annulled.
  • EUIPO and New Yorker Marketing & Media International GmbH shall each bear their own costs and half of BIW Invest AG's costs, including those incurred before the Board of Appeal.
