Ratio Decidendi

The Board of Appeal erred in finding only a low degree of visual similarity between the marks; the marks have at least an average degree of visual and phonetic similarity, and the goods are partly identical and partly similar. Given the normal distinctiveness of the earlier mark and the neutral conceptual comparison for most of the relevant public, there is a likelihood of confusion. The contested decision must therefore be annulled.
