The Court held that Article 15(3) of Decision 2011/278/EU and Article 4 and Annex II to Decision 2013/448/EU are valid. The Commission did not exceed its implementing powers under Directive 2003/87/EC by excluding emissions from electricity generators and certain cogeneration activities from the correction factor calculation.
