Ratio Decidendi

The Commission erred in law by refusing access to data from the Euromonitor database on the ground that it was not in its possession, as the Commission had a valid subscription and used the data in preparing the Report. However, the Commission was justified in refusing access to data from the EU-CEG and traceability system databases, as extraction would require substantial investment and creation of new documents. The applicant failed to rebut the presumption that no intermediate documents existed. The Commission's statement of reasons was sufficient.
