Ratio Decidendi

A person or entity that, as policyholder, maintains group insurance for customers, enables voluntary enrolment for a fee, and thereby provides insurance cover to those customers, acts as an insurance intermediary within the meaning of Directives 2002/92/EC and 2016/97/EU. The fact that the entity is the policyholder does not preclude intermediary status if the activity is for remuneration and functionally equivalent to insurance mediation/distribution.
