Ratio Decidendi

Article 2(11) of the basic regulation requires inclusion of all export transactions in dumping margin calculation; exclusion of certain product types due to lack of matching analogue country products is unlawful. Fair comparison must be achieved through adjustments, not exclusion. The General Court erred in law by allowing exclusion of transactions.
