Ratio Decidendi

The Court of First Instance erred in law by requiring the Commission to compare the remuneration received by La Poste with that demanded by a private group not operating in a reserved sector. Where no equivalent private market exists, normal market conditions must be assessed by reference to objective and verifiable elements, such as the costs borne by La Poste, including all additional and variable costs, an appropriate contribution to fixed costs, and an adequate return on capital investment. If these are properly covered and not underestimated or arbitrarily fixed, there is no State aid.

Court Disposition

Appeal allowed; judgment of the Court of First Instance set aside; case referred back to the Court of First Instance; costs reserved.
