Ratio Decidendi

The Court of First Instance erred in law by requiring comparison with private undertakings not operating in a reserved sector. Where no market equivalent exists, normal market conditions must be assessed by reference to objective and verifiable elements, such as the costs borne by the public undertaking. If the price charged covers all additional, variable costs, an appropriate contribution to fixed costs, and an adequate return on capital investment, and these elements are not underestimated or arbitrarily fixed, there is no State aid.
