Ratio Decidendi

Article 20(1) of Directive 2003/54/EC precludes national legislation that excludes, as a general rule, the application of third party access provisions to distribution systems located on a geographically connected operation zone and predominantly serving the energy needs of the undertaking itself or connected undertakings. Such systems must be regarded as 'distribution systems' under the directive, and general exemptions are not justified without individual assessment of burdens or circumstances.
