Ratio Decidendi

A contracting authority is not authorised under Directive 2004/18/EC to require, by stipulation in tender specifications, that the future contractor perform with its own resources a certain percentage of the works. Such a requirement constitutes an irregularity under Regulation (EC) No 1083/2006 if it cannot be excluded that it impacts the EU budget, justifying a financial correction, the amount of which must consider the nature, gravity, and financial loss to the Fund.
