Ratio Decidendi

The Board of Appeal erred in finding similarity between 'vêtements (à l’exception des peignoirs de bain)' in class 25 and the goods in class 24, as these are not similar under established case law. The Board also erred in assessing the similarity between parasols and umbrellas as 'medium' rather than 'low', but the high similarity between the marks compensates for the low similarity of these goods. Therefore, the decision is annulled and reformed in part: the nullity request is rejected for 'vêtements (à l’exception des peignoirs de bain)' in class 25; the remainder of the appeal is dismissed.
