Ratio Decidendi

The Council's failure to adopt the proposal for a regulation imposing definitive anti-dumping duties, together with the expiry of the 15-month period, constituted a reviewable act under Article 173 EC Treaty, as it produced binding legal effects affecting the appellants' interests. The Council failed to provide an adequate statement of reasons for its decision, warranting annulment. However, inadequacy in the statement of reasons is not sufficient to incur Community liability for damages.
