  1. 1 Whether the Board of Governors of the European Investment Bank could lawfully allocate proceeds of income tax withheld from staff salaries and pensions to the Bank's reserves and income, rather than to the Communities' budget as required by EU law.

Ratio Decidendi

The Board of Governors' decision to allocate the proceeds of the income tax withheld from staff salaries and pensions to the Bank's reserves and income, rather than to the Communities' budget, contravened Articles 13 and 22 of the Protocol on the Privileges and Immunities of the European Communities and Regulation No 260/68, which require such proceeds to be paid into the Communities' budget. The Council was empowered to determine these conditions, and the Bank's autonomy does not override this obligation.
