Ratio Decidendi

The Rotterdam Convention pursues two indissociably linked objectives—regulation of international trade in hazardous chemicals and protection of human health and the environment—neither of which is secondary. Therefore, the Council Decision should have been based on both Article 133 EC (common commercial policy) and Article 175(1) EC (environmental policy). Since the contested decision was based solely on Article 175(1) EC, it must be annulled to the extent of that deficiency.
