Framework Decision 2005/667/JHA, by requiring Member States to provide for criminal penalties for ship-source pollution, encroached on the Community competence under Article 80(2) EC and infringed Article 47 EU. The Framework Decision should have been adopted as a Community act, not under Title VI of the EU Treaty. As the measure is indivisible, it must be annulled in its entirety.
