Ratio Decidendi

Germany, having permitted increases in natural alcoholic strength by volume, could not lawfully prohibit the use of rectified concentrated grape must as an enrichment method, as this is expressly allowed by Article 33 of Regulation No 337/79. No other EU provisions cited by Germany allow such a restriction. Therefore, Germany failed to fulfil its obligations under the common organization of the market in wine.
