By making own resources available to the Community too late, the Federal Republic of Germany failed to fulfil its obligations under Article 49 of Regulation No 1214/92 and Article 379 of Regulation No 2454/93, read together with Article 2(1) of Regulation No 1552/89. The relevant time-limits are mandatory, and Germany’s delays constituted an infringement. The Court cannot order payment of default interest in this context.
