The 1990 Law altered the situation of carriers from other Member States unfavourably compared to national carriers by compensating national carriers for the road tax with a vehicle tax reduction, in breach of Article 76 EEC Treaty. Bilateral agreements do not justify the discrimination, and environmental protection does not excuse the breach. The law obstructed the common transport policy.
