Ratio Decidendi

Germany failed to fulfil its obligations under Article 6(1)(a) of Annex I and Article 6(a) of Annexes II and III to the IDA, and under Regulation (EEC) No 1999/85, by authorizing imports of dairy products under inward processing relief at prices below the minimums set by the IDA. The IDA applies to such imports, and Community law provided Germany with the means to prevent the infringement. The Commission was not required to await the Article 113 Committee's opinion before bringing proceedings.
