Ratio Decidendi

Germany failed to fulfil its obligations under Article 10 of Directive 92/50/EEC in conjunction with Article 16 thereof, and since 1 February 2006, under Article 22 of Directive 2004/18/EC in conjunction with Article 35(4) thereof, by not publishing notices of the results of contract award procedures for public emergency ambulance and qualified patient transport services in the Länder of Saxony-Anhalt, North Rhine-Westphalia, Lower Saxony, and Saxony. The activities at issue are not directly and specifically connected with the exercise of official authority and are not excluded from procurement law. Article 86(2) EC does not justify the lack of transparency.
