Germany failed to fulfil its obligations under Article 7(2) and (4) of Regulation 259/93 by raising objections to shipments of waste intended for use as fuel in other Member States based on criteria not relevant under Community law, as the use of waste as fuel in cement kilns constitutes a recovery operation when the principal objective is energy generation.
