Ratio Decidendi

The Court held that Belgium's taxes on stock exchange transactions and on the delivery of bearer securities, to the extent they apply to new issues and their immediate acquisition or delivery, violate Article 11 of Directive 69/335. The first acquisition or physical delivery of securities upon issue is inseparable from the issue itself and cannot be taxed. The Article 12(1)(a) derogation for transfer duties does not apply to these initial transactions.
