Ratio Decidendi

The regional tax is a direct tax imposed on owners, not on the Communities. Article 3(1) of the Protocol exempts the Communities from direct taxes but does not extend exemption to contracting parties or prohibit passing on tax costs via contract. The passing on of the tax is a matter of contractual freedom, not fiscal law. There is no evidence that this arrangement impairs the Communities' independence or functioning. The introduction of the regional tax does not violate Article 3 of the Protocol.
