Ratio Decidendi

These restrictions are not justified by overriding requirements relating to the general interest, as no such justification is advanced for KPN, and in the case of TPG, the measures are not proportionate or limited to what is necessary to safeguard the provision of a universal postal service. Therefore, the Netherlands has failed to fulfil its obligations under Article 56 EC.
