Austria failed to fulfil its obligations under Article 2(1)(a) and (b) of Directive 89/665/EEC and Directive 92/13/EEC because the regional public procurement laws of Salzburg, Styria, Lower Austria, and Carinthia did not in all cases provide for a review procedure allowing unsuccessful tenderers to have award decisions set aside prior to contract conclusion, and administrative circulars or non-binding decrees do not constitute adequate transposition of EU law.
