While environmental protection is a legitimate objective, the measure was disproportionate because Austria did not sufficiently examine less restrictive alternatives or ensure adequate rail capacity. The regulation also failed to comply with procedural requirements under Directive 96/62/EC. Therefore, the ban was incompatible with EU law.
